Translation of the draft Rules of Procedure of the Unified Patent Court
On 30 November 2013, Véron & Associés published a translation of the draft Rules of Procedure of the Unified Patent Court.
For several decades, the creation of a common European court to hear patent litigation cases has been a recognised need.
After many unsuccessful attempts, on 19 February 2013, twenty-five Member States of the European Union signed an international agreement creating the Unified Patent Court, a court common to these States, which is to become operational in 2015.
Rules of Procedure are necessary to permit this court to operate, because there is no European procedure code that it may apply.
The members of Véron & Associés actively participated in the work on drawing up these Rules: in particular, Pierre Véron is one of the seven members of the Drafting Committee that assists the Preparatory Committee for the Unified Patent Court in its drafting.
To enable French parties interested in this draft, released in English, to be more easily acquainted with it, Véron & Associés produced a full French translation of the 382 articles of this draft, which constitutes a real European Civil Procedure Code for patent litigation.
The German law firm Reimann Osterrieth Köhler Haft, specialist in industrial property litigation produced the German translation of the draft.
The UK law firm Powell Gilbert joined this venture.
A trilingual version of the Agreement on the Unified Patent Court dated 19 February 2013 and the 15thRules of Procedure draft was subsequently published in November 2013.
This book has been made available to interested parties.
It is available in electronic format on the website www.upc.documents.eu.com created by Véron & Associés to give access to key documents publicly available on the European patent with unitary effect and European Unified Patent Court.
Prix Opéra 2013
Véron & Associés is rewarded by the jury of Prix Opéra for “Saisie-contrefaçon as a book, a film and a conference”
In Paris, on Tuesday 3 June 2013, in front of an audience of more than 250 people assembled at the Maison du Barreau, the jury of Prix Opéra awarded their 3rd prize to Véron & Associés for “Saisie-contrefaçon as a book, a film and a conference.”
The jury commented: “The law firm illustrates with pedagogy and in an entertaining way the saisie-contrefaçon across a book, a film and a conference.”
Véron & Associés (www.veron.com), leading patent litigation specialist firm in France entirely devoted to patent litigation, published at the end of 2012, the 3rd edition of Saisie-contrefaçon in the Dalloz Référence collection.
In addition, the law firm chose to illustrate the saisie-contrefaçon procedure through the production of a film created by the members of the law firm.
The saisie- contrefaçon is presented step by step: exchanges between the intellectual property right-holder and his legal counsel, drafting and submission of the saisie-contrefaçon request to the judge, conducting the saisie-contrefaçon on the premises of the firm accused of infringement, commencement of the proceedings on the merits of the case.
Finally, on 17 December 2013 at the Palais de la découverte in Paris, Véron & Associés organised a conference on the procedures comparable to the saisie-contrefaçon existing throughout major European countries.
